The announcement of the 5/4 vote by the Supreme Court to overturn Roe v Wade which 50 years ago gave women in America the right to a safe and legal abortion, goes to the heart of the Plot Against America. I am sure that there will be many evangelical Christians and arch-conservative Catholics who are delighted with the outcome. The 5/4 vote breaks down as, Catholic Fundamentalist 5, Catholics taking the bad look of the fundamentalists 1 and 3 others who believe in a woman’s right to choose. The god-fearing Catholics, Barrett, Gorsuch and Cavanaugh when asked at their confirmation hearings, if they would overturn Roe, the answer was that it was settled law. It is now clear that the US Supreme Court is just another Roman Catholic institution with liars on the bench. Just to remind the trio, of Psalm 101/7” No one who practices deceit shall dwell in my house; no one who tells lies shall stand in my presence.”
In May 2017 when Barrett was being confirmed for a seat on the U.S. Circuit Court of Appeals, Senator Dianne Feinstein said to Barrett, “The dogma lives loudly within you,” implying that Barrett’s legal philosophy was inordinately influenced by her religious beliefs. Bull’s eye. This attack on a woman’s right to choose will now allow red states to ban abortion outright on any grounds including rape, gang rape, incest and paedophilia. It will encourage some red states to go further by trying to ban the use of the abortion pill and who knows maybe, types of contraceptives. The breaking of any new laws will be enforced by a raft of draconian criminal sanctions. This decision by the Supreme Court will impact women who are the poor, vulnerable and members of minorities. This decision will cost lives, as these marginalised women seek out backstreet abortions, while better-off white women from red states can simply jump on a plane to the nearest blue state.
The Vatican has welcomed the decision by saying that it was a” powerful invitation to reflect on the issue at a time when Western society is losing passion for life.” This is from an institution whose passion for destroying the lives of children and then trying to cover it up, is well documented.
The Supreme Court on a 6/3 decision, red necks versus progressives, again expanded gun rights, allowing concealed carry outside the home. This is a further retrograde step in expanding the interpretation of the 2nd amendment. Ironically, this was just after Congress passed a low-bar gun control bill. You do not have to be a rocket scientist to work the consequences of everyone carrying concealed firearms. Just image road rage in America, or getting a seat on a busy subway, someone giving the one finger, jaywalking, etc. These could be literally, the new trigger events for gun violence. Yes, I am serious. The Justices took this decision in the light of the most recent gun violence tragedies in Uvalde where 19 children were shot and in Buffalo where 9 African Americans were shot in a food store just for being black. Do these 6 justices have any moral scruples or empathy, when Justice Thomas in writing the majority decision said in the ruling’s most far-reaching language, that concern for public safety isn’t enough to justify new gun controls. This is the same Clarence Thomas who now thinks it is fair to take a pot shot at, same sex marriage and contraception and whose wife is a mad Trump Republican who participated in trying to overturn the 2020 election.
As it stands, it seems that it is the Supreme Court that is undermining not just democracy but the democratic republic itself. In 2010 the Supreme Court’s controversial decision in the case of Citizens United V Federal Election Commission reversed a century-old campaign finance restrictions. It has now enabled corporations and other outside groups to spend unlimited funds on elections. This saw the creation of super PACs funded by the likes of the ultra-conservative republican supporting Koch Brothers and the NRA. The decision of the court has allowed money to be the most useful and important instrument in the election toolbox. This has had the effect of corrupting the election process by endorsing that, politicians can be bought and amplifying even further, the voice of the rich and powerful. Money spent on the 2020 Presidential election and down-ballot elections totalled north of $14B, by comparison, in the UK parliamentary election of 2019 the spend was under £50m. If Americans cannot see this as a problem, not even God can help them.
They also tore the heart out of the Voting Rights Act in 2013 by allowing States to change election laws without the approval of the Federal Election Commission, in effect making voter suppression legal and upholding even further the dreaded principle of state rights. Chief Justice John Roberts wrote for his Court opinion that “The ‘pervasive,’ ‘flagrant,’ ‘widespread,’ and ‘rampant’” racial voter discrimination that Congress addressed in the Voting Rights Act of 1965 no longer existed. What a f’ing plonker. This aspect of the Voting Rights Act ensured that states and localities with a history of discrimination against minority voters, namely African Americans had to get changes cleared by the federal government before they went into effect.
So, to sum up, it is not just the Trump Republicans, fundamentalist evangelicals, ultra-conservative Catholics, white nationalists, and NRA that are undermining the republic, you can now add, “The Commanders of the Faithful” as constituted in the Handmaids Tale formerly known as the US Supreme Court.
